TIME OF THE ESSENCE

Let me caution you concerning a tricky aspect of contract law.

We all sign contracts throughout the business year.

Here in my law office a common misconception about time by many sections of society.

People often assume that they will be given certain grace periods or forgiveness for tardiness from the law when complying with contract requirements.

Please be aware that when a contract states ……. “time is of the essence” it means there are no automatic extensions of time to act or forgiveness for failure to perform under the terms of the contract.

Miss a deadline and you have lost the protection you wanted from that contract.

When the lawsuit comes against you for failure to comply with the contract, there will be a lawyer like me on the other side who knows full well what that contract clause “time is of the essence” means.
