ESTATE PLANNING SPECIAL NEEDS TRUST
FOR DISABILITY BENEFITS PRESERVATION
Let me caution you about leaving part of your estate to a family member with physical or mental handicaps, in other words, a disabled family member.
An example would be a disabled adult child receiving supplemental security income (SSI) or Medicaid.
If a parent or anyone else dies and leaves property to the adult child, the adult child will become ineligible for those government benefits.
Worse, you will be forced to spend virtually all his inheritance on his care in order for him to become eligible for government benefits again..
Prevent this needless calamity by having the disabled child’s share of the inheritance paid into a special needs trust for the child’s benefit.
The special needs trust allows the adult beneficiary to continue receiving his government benefits AND enjoy the benefits of the inheritance also.
How hard is this special needs trust to set up?

But for the savvy/experienced attorney, it’s not hard at all.
