Let me caution you that estate settlement has more psychological pitfalls than most any other area of the law.
Because there is money, heirlooms and property involved, people get very emotional about getting their cut.
Unfortunately, Hollywood paints a picture of calm, reasoned estate settlement with everyone sitting around the conference room table.
Hollywood couldn’t be further from the truth.
The reality is a big family fight.
We have all seen it happen.
Maybe, even in your own family.
There are certain common pitfalls you need to avoid.
Some heirs may ask for preferred treatment.
Some heirs may ask for advance distributions ahead of other heirs.
Some heirs may ask for heirlooms, to which to which they have no right.
There are nervous or irritable heirs watching to be sure that all of the assets and liabilities are handled correctly.
You can very easily wind up with displeased heirs who feel they are treated unfairly or the estate handled improperly.
People do not always behave rationally after a loved one dies.
You could even be sued by the heirs.
