DEALING WITH THE ESTATE WITH A TRUST
Let me tell you something you might not know about working with the estate of a deceased person who had dealings with trusts during life, either as a beneficiary or as the trustee administering the trust.
You need to go find the governing the trust itself.
It could be a free standing trust document or it could be in a Last Will and Testament which includes the testamentary trust.
It is entirely possible that the deceased owned some interest in trust that must be included in his estate. You have to report that asset.
You may also have to work with a successor trustee to transfer management duties which were formerly handled by the deceased.
There are probably other beneficiaries of the trust waiting to receive their benefits.
All these matters require the knowledge of the law of trusts, as well as estate settlement.
This is why I recommend leaving an estate administration open for at least a year before settlement and closing.
