ESTATE SETTLEMENT PHILIP SEYMOUR HOFFMAN UNENFORCEABLE PROVISION

Let me tell you something you can’t do in a will.

The late great Hollywood star, Philip Seymour Hoffman, of the Hungar Games wrote his will and tried to force his children’s mother to rear the children in only three cities.

He stated in his will, “It is my strong desire that my children be raised and reside in the borough of Manhattan, New York or Chicago, Illinois or San Francisco, California.”. He wanted the children to be exposed to culture, arts and architecture that such cities offer.

Such desires stated in the will are however ……. not enforceable by law.

No amount of money can make a court enforce requests like this in a last will and testament.

Often the caregiver of the children will make some reasonable effort to reside near such places or visit them as opportunity arises.

A court will not micromanage the children’s caretaker to the point of deciding where the children must live.

In making your own will, I want you to be certain what the law can do and what the law cannot do.
